HB 101: RIGHTS-OF-WAY – Amends existing law to establish requirements regarding the vacation of public rights-of-way that furnish access to state or federal public lands or waters.
Amends Section 40-203, Idaho Code, to establish procedures for county and highway district commissioners to abandon public rights-of-way providing access to state/federal public lands or waters. Requires replacement access before vacation, prohibits eminent domain for replacements, and declares emergency effective date of July 1, 2025.
