HB 218: IDAHO ADMINISTRATIVE PROCEDURE ACT – Adds to existing law to establish provisions regarding expiration on rulemaking authority.
Adds new Section 67-5233 to Idaho Code establishing a 10-year expiration on agency rulemaking authority for statutes passed on/after July 1, 2025. Agencies must promulgate all necessary rules within 10 years; after that period, new rules require legislative amendment or new statute conferring authority (within 2 years). Effective July 1, 2025.
