HB 244: ELECTRONIC SMOKING DEVICES – Adds to existing law to establish an illegal electronic smoking devices brand list.
Adds new Section 39-5719 to Idaho Code requiring the Department of Health and Welfare to publish a list of illegal electronic smoking device brands based on FDA enforcement actions. Prohibits sales of listed brands starting September 1, 2025, with escalating fines, permit suspensions, seizures, and compliance inspections. Exempts FDA-authorized products and certain grandfathered devices.
