HB 321: PROPERTY RIGHTS – Adds to existing law to establish provisions regarding a limited alternative remedy to remove unauthorized persons from residential real property, to provide for the crime of making false statements to detain real property, and to provide for the crime of fraudulent sale or lease of residential real property.
Establishes expedited sheriff procedure for property owners to remove unauthorized squatters from residential property under strict conditions (not tenants/family, no litigation). Creates misdemeanor for false lease/deed documents and felony for fraudulent property sales/leases. Effective July 1, 2025.
