HB 361: HOMEOWNER’S ASSOCIATIONS – Amends and adds to existing law to revise provisions regarding definitions and fee and financial disclosures and to establish provisions to provide for a period of declarant control, restrictions on board membership, and proxy votes.
Reforms homeowner's association (HOA) governance by clarifying definitions, mandating declarant turnover of board control at 75% and 95% lot sales, limiting proxy voting power, restricting board membership to one per lot/household, and strengthening fee/financial disclosure requirements. Effective July 1, 2025.
