HB 362: PUBLIC OFFICE – Amends existing law to provide that subscribing to the oath of office for certain elective offices shall create a vacancy in certain other offices.
Amends Idaho Code §59-901 to create vacancies in certain local elective offices (cities >1,000 pop., school districts >500 students, highway districts in counties >10,000 pop.) when the holder subscribes to the oath for a federal, statewide, or legislative office. Exempts temporary/emergency legislative successors. Effective January 1, 2026.
