SB 1039: IMMIGRATION COOPERATION AND ENFORCEMENT ACT – Adds to existing law to provide for cooperation with federal authorities, to provide for cooperation with immigration detainers, to provide for the crime of unlawful presence of a dangerous illegal alien, and to provide for the crime of smuggling a dangerous illegal alien.
Creates new Chapter 90, Title 18, Idaho Code, establishing the Immigration Cooperation and Enforcement Act. Criminalizes unlawful presence of dangerous illegal aliens (misdemeanor first offense, felony subsequent), smuggling dangerous illegal aliens (felony), mandates cooperation with federal immigration authorities and detainers, requires alienage determination upon confinement, imposes 5-year sentencing enhancement for illegal aliens committing dangerous crimes, and provides immunity for officials.
