SB 1084: WATER SUPPLY BANK – Amends existing law to provide that the forfeiture period restarts upon removal of a water right from the water supply bank.
Amends Idaho Code § 42-1764 to revise water right forfeiture provisions for the water supply bank. Provides that the 5-year nonuse forfeiture period restarts upon removal from the bank if no prior nonuse occurred, or continues accruing if prior nonuse existed. Declares emergency effective July 1, 2025.
