HB 489: CRIMES AND PUNISHMENT – Adds to existing law to prohibit the use of a mask or disguise during a criminal offense and to provide for a sentencing enhancement.
HB489 adds a new section to Idaho Code prohibiting the wearing of a mask, hood, or other face-covering device while committing or attempting any other criminal offense. Upon conviction, it permits a sentencing enhancement of up to one additional year of imprisonment, a fine of up to $2,500, or both, on top of the penalty for the underlying crime. The bill includes severability, an emergency clause, and an effective date of July 1, 2026. It was recommended for passage by committee and is currently at second reading in the House.
