HB 507: MILITIA AND MILITARY AFFAIRS – Amends existing law to revise terminology and to revise provisions regarding restraint and nonjudicial punishment in the Model State Code of Military Justice.
This legislation updates the Idaho Code of Military Justice (Title 46, Chapter 11) to better align with Idaho National Guard operations in Title 32 or state active duty status. It revises definitions and terminology, expands commanders' authority to impose nonjudicial punishment at lower levels, limits service members' ability to refuse NJP in most cases, makes summary courts-martial mandatory for certain misconduct, removes references to naval forces and other inapplicable language, and eliminates unconstitutional arrest and seizure provisions following a state Supreme Court ruling. The bill passed both chambers unanimously and took effect July 1, 2026, with no projected fiscal impact on state funds.
