HB 522: UNMANNED AIRCRAFT SYSTEMS – Adds to existing law to establish provisions regarding unmanned aircraft systems near Department of Correction facilities.
HB 522 adds new Idaho Code Section 20-251 prohibiting unmanned aircraft systems (drones) within 400 feet of correctional facilities. It defines restricted airspace, mitigation measures such as jamming, and nefarious use. The Department of Correction and law enforcement may deploy mitigation measures with reasonable suspicion of illegal activity if consistent with federal law. Violations are misdemeanors punishable by up to $1,000 fine, six months imprisonment, and possible drone forfeiture. Facilities must post Drone No Fly Zone notices. The bill was amended in the Senate to refine definitions, lower penalties from the introduced version, add liability protections and operator responsibilities, and declare an emergency. It is now law and effective July 1, 2026.
