HB 744: BIOMETRIC IDENTIFIERS – Adds to existing law to establish provisions regarding the capture or use of biometric identifiers.
Establishes new Chapter 21, Title 48, Idaho Code, regulating commercial capture and use of biometric identifiers (retina/iris scans, fingerprints, voiceprints, hand/face geometry). Requires informed consent before collection, prohibits sale/disclosure except in limited cases, mandates secure storage and destruction within one year of purpose expiration, allows consent revocation, and imposes civil penalties up to $25,000 per violation. Exempts certain AI training and security uses. Effective July 1, 2026.
