SB 1232: CRIME VICTIMS – Repeals and adds to existing law to establish provisions regarding proceeds derived from criminal notoriety.
SB1232, now effective law as of July 1, 2026, repeals the prior statute on crime-related proceeds and enacts the Idaho Son of Sam Law. It requires any money an offender earns by commercially exploiting the notoriety of their crime to be placed in a state escrow account for five years. Victims receive notice and may file claims for restitution or civil damages. Remaining funds return to the offender after valid claims are paid. The law includes multiple exceptions and explicit safeguards to protect free speech rights, regulating only profits and not expression itself.
