SB 1299: DIGITAL IDENTIFICATION – Adds to existing law to establish provisions regarding limitations on digital identification.
SB 1299 adds Section 67-2364 to Idaho Code establishing limits on digital identification. Public entities cannot require digital ID to access services, benefits, licenses, employment, education or other functions. Physical IDs remain valid. The law bars requiring people to unlock personal devices for verification and states that presenting digital ID is not consent to search the device. Data use is restricted to immediate verification with no tracking or long-term retention allowed. The Attorney General may enforce after notice and cure period. Aggrieved persons may sue for relief and prevailing plaintiffs recover attorney fees. The bill passed both chambers without opposition, was signed by the Governor, and became effective July 1, 2026.
