SB 1326: PROPERTY RIGHTS – Adds to existing law to establish provisions regarding property rights protection.
SB 1326 enacts the Property Rights Protection Act by adding a new chapter to Idaho law. It prohibits government agents from entering private lands not open to the public without a warrant, consent, or exigent circumstances. Federal agents must notify the county sheriff before executing warrants. A $1,000 civil penalty applies to knowing violations (with exemptions for local law enforcement). The law includes broad exceptions for water rights, noxious weeds, welfare checks, and other government functions. The bill was amended, passed both chambers, signed by the Governor, and became effective March 31, 2026.
