SB 1352: HOUSING – Adds to existing law to establish provisions regarding starter home subdivisions.
This enacted law adds Idaho Code Section 67-6541 prohibiting cities with populations over 10,000 from banning starter home subdivisions in residential zones. It requires these cities to allow lots as small as 1,500 square feet, reduced setbacks (15 ft front/rear, 5 ft side), narrower frontages (30 ft), shallower depths (70 ft), and equal fees compared to standard single-family homes. Historic districts are exempt and health, safety, infrastructure, and environmental rules remain in force. The measure passed both chambers, was signed by the Governor, and took effect July 1, 2026.
