SB 1353: HOUSING – Adds to existing law to establish provisions regarding regulation of twin homes and duplexes.
SB1353 adds a new section to Idaho law requiring cities with populations over 10,000 to allow twin homes and duplexes in all single-family residential zones. It bans local ordinances prohibiting these units, restricts excessive minimum lot sizes, limits parking mandates to one space per unit in many locations, and prevents higher per-unit fees than single-family homes. Qualifying projects receive administrative approval as a matter of right. Historic districts are exempt and critical safety, infrastructure, and environmental rules remain in force. The measure takes effect July 1, 2026.
