SB 1354: ACCESSORY DWELLING UNITS – Amends and adds to existing law to revise provisions regarding prohibitions against restrictive covenants banning accessory dwelling units and to establish provisions regarding accessory dwelling units in the Local Land Use Planning Act.
SB 1354 is now effective law as of July 1, 2026. It revises HOA rules to prohibit bans on accessory dwelling units (ADUs) unless the property owner expressly agrees in writing. The bill also adds new requirements in the Local Land Use Planning Act directing cities with populations over 10,000 to allow ADUs in single-family zones. Cities must adopt objective standards for size, parking, fees, height, and administrative approval to facilitate construction while preserving health, safety, and historic protections.
